1. Services
WinterGreen Services LLC (“WinterGreen,” “we,” “our,” or “us”) provides professional property maintenance services in the Milwaukee, WI metropolitan area, including:
- Snow removal — shoveling and salting bundled as a single service
- Lawn care — a full visit consisting of mowing, weed whacking, trimming, and blowing
All services are weather-dependent and subject to availability. We reserve the right to modify, delay, or cancel services due to unsafe conditions, equipment failure, or extreme weather events.
2. Payment Terms
WinterGreen uses per-visit billing (not subscription-based). You are charged after each completed visit, following admin approval. A valid credit or debit card on file is required for all active customers. By providing your card, you authorize WinterGreen to charge it automatically via Stripe after each approved visit.
Approval requires four gates: service marked complete, before photo uploaded, after photo uploaded, and no active dispute.
Failed payments are handled as follows: a 5-day grace period for card update; service pause if unresolved; escalation at 14 days; and cancellation of service if payment remains outstanding. Outstanding balances remain due regardless of service status.
3. Snow Removal
During onboarding, each customer selects a snowfall trigger threshold (1″, 2″, or 3″; default is 2″). When the National Weather Service (NWS) reports snowfall at or above your threshold for your ZIP code, a snow removal job is automatically triggered. Service is activated within 24 hours of storm conclusion.
Snowfall multiplier pricing:
- 0–4″ accumulation — standard quoted price
- 4–8″ accumulation — 1.5× standard price
- 8″+ accumulation — 2.0× standard price
Multiplier pricing will be disclosed to you at the time of your initial quote. Snow removal includes both shoveling and salting as a bundled service.
4. Lawn Care
Lawn care visits are scheduled on a recurring basis (weekly or bi-weekly) during the approximate season of May through October. Each visit includes mowing, weed whacking, trimming, and blowing. You may skip or reschedule a visit with reasonable advance notice.
5. Pricing
Quotes are based on measured property dimensions and the complexity of the service area. There is a minimum charge of $30 per visit for all service types. Snow removal pricing may vary by storm severity per the snowfall multiplier described in Section 3. Rates are subject to change with at least 30 days' written notice.
6. Service Quality & Re-Service
If you are dissatisfied with the quality of a completed visit, our default resolution is a free re-service, not a refund. To request a re-service, you must report the issue within 48 hours of service completion and provide photo evidence of the concern. Refunds are issued only for confirmed billing errors. WinterGreen does not provide refunds for subjective dissatisfaction when service was performed to standard.
7. Photos
Before-and-after photos are taken at every service visit for quality documentation and customer notification. By accepting these Terms, you consent to exterior photos of your property being taken and stored by WinterGreen for service documentation purposes.
8. SMS/Text Message Consent
By accepting these Terms, you consent to receive transactional text messages from WinterGreen's commercial phone number, including service reminders, job completion notifications, and billing notices. Marketing text messages require separate opt-in and are not sent without your additional consent.
You may opt out of text messages at any time by replying STOP. Opt-out applies to marketing messages only; transactional messages related to active service may continue unless your account is cancelled. Message and data rates may apply. Message frequency varies.
Text messaging originator opt-in data and consent will not be shared with any third parties.
9. Email Communications
You consent to receive service-related emails from WinterGreen (e.g., job completion summaries, payment receipts, service updates). Commercial emails such as review requests or seasonal promotions will include an unsubscribe link in compliance with CAN-SPAM.
10. Cancellation
You may cancel your service at any time by contacting WinterGreen. There is no cancellation fee. Any outstanding balance remains due upon cancellation. Service ceases effective immediately or at the end of the current service week, at WinterGreen's discretion.
11. Liability & Insurance
WinterGreen carries General Liability, Workers' Compensation, and Hired & Non-Owned Auto (HNOA) insurance. Our liability is limited to direct damages arising from proven negligence by WinterGreen or its employees. We are not responsible for pre-existing property damage, re-freeze or ice formation after service completion, or conditions that develop after service is performed. You assume slip and fall hazard risk following service completion.
12. Property Access
By enrolling in service, you grant WinterGreen and its employees permission to access your property for the purpose of performing scheduled services. You are responsible for ensuring clear access to service areas, marking obstacles (e.g., landscaping features, extension cords, decorative items), and securing pets. Gate codes and access instructions are stored securely in our system. WinterGreen is not liable for damage to unmarked or hidden objects.
13. Dispute Resolution & Governing Law
Before initiating any formal legal action, you agree to first contact WinterGreen to attempt to resolve the dispute informally. Most concerns can be resolved quickly by emailing info@wintergreenmke.com.
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to the personal jurisdiction and venue of such courts.
14. Data Privacy
Customer data is collected and used solely for service delivery, billing, and communication purposes. Payment information is handled securely by Stripe and is not stored on WinterGreen servers. For full details on data collection, usage, and retention, please refer to our Privacy Policy.
15. Modifications
We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
